File Description [top]

The TRADEMARKSCAN® - Japan (File 669) database is produced by Thomson CompuMark. The database principally serves as a preliminary trademark screening tool for checking on the availability of new product and service names.

Like the other TRADEMARKSCAN files, TRADEMARKSCAN - Japan should not be used as the sole basis for clearing a new name or for filing a trademark application. If a trademark is not found in the database, it does not necessarily mean that the trademark is available for use. Registration does, however, confer the exclusinve right to the use of a trademark and offers a greater degree of protection from infringement.

TRADEMARKSCAN - Japan features full records that contain the trademark, application and registration numbers, international and national class(es), status, current owner, dates, Japanese pronunciation, character type and other pertinent information. Trademarks can be searched as phrases (ET=), as whole words or word beginnings in the Basic Index, or as word fragments or word endings in the rotated index TR=. Trademark design/logo images can be located by restricting a search with RT=IMAGE. Color images are provided when available. Other information about the mark such as e.g., Design Type (DT=), Lining/Color Claims (PH=), and Opposition (OP=) are also included.

TRADEMARKSCAN - Japan can be searched individually or in conjunction with other trademark files. The OneSearch categories, TMKS or TRDMRKS, cover all trademark databases. The ASIATMKS category covers Australia, China, Japan, South Korea.

1 Use the Basic Index to search complete words, compound words, or word beginnings, e.g., S KIN?. Use the rotated index TR= to search word fragments, or word endings, e.g., TR=KIN?. Since punctuation is stripped for trademark searching, use the AND operator instead of the (W) operator for the most comprehensive retrieval. Search compound words as the whole word and as its parts, e.g., S KINGS? OR (KING AND COBRA?).

2 Since trademarks are not cross-referenced, for the most comprehensive retrieval, alternative spellings should be SELECTed either in the Basic Index, e.g., SELECT HARBOR OR HARBOUR OR HAVRE or in the Rotated Trademark index, e.g., SELECT TR=(HARBOR? OR HARBOUR? OR HAVRE?).

3 Japanese pronunciation (JP=) is also searchable in the Basic Index. Because of the transliteration that occurs between English and Japanese, it is a good idea to search Japanese pronunciation when verifying exact trademarks. For instance, the English word GENEROUS has a Japanese pronunciation JP=GENERASU.

4 Appeals (AI=) contains the appeal action, appeal number and date of the appeal. The appeal date is not searchable..

5 Named Company [CO=] includes Owner (ON= and OW=), Agent/Correspondent (LR=), and Opposition (OP=)(when present).

6 In a REPORT which includes date fields, NA will appear when the requested date information is not available. Trademark and owner names longer than 32 characters are truncated in REPORT displays.

7 Historical Information is not searchable but does include additional information regarding status changes pertaining to the trademark

8 Invalidations data (JI=) contains searchable actions, i.e., Total Invalidation and Partial Cancellation, and the number associated with the action. The action date displays but is not searchable..

9 The Goods/Services field is not provided for Japanese trademarks. To search goods information use the text descriptions for Japanese National Classes (NC=).

10 The Japanese National Classification (NC=) consists of class numbers and class descriptions, when available. The descriptions are translated from the Japanese, and are not uniform. Use EXPAND to view possible variations of classes and descriptions, or search several synonyms. When searching the class codes, always add a question mark to capture all occurrences of the class, e.g., S NC=19B39?.

11 The Notes field [NT=] contains miscellaneous action information pertaining to the trademark such as duplicate applications, concurrent registrations, etc.

12 Each Emperor Year application number is prefixed with the first letter of that era's emperor: M=Meji, T=Taigo, S=Showa and H=Heisei. All application numbers from 2000 onwards use the Western Year.

13 "Almost" duplicates can occur in this file, either in the Application or Registration Number fields wherein a single number will retrieve more than 1 record. These records typically have different national classes. Identified duplicates can be found in the Notes (NT=) field where they can be searched by number.

14 Records containing trademark images can be located by including RT=IMAGE in the search. Images display in Formats 15 and 19 when searches are conducted using DialogLink 5, Dialog Classic on the Web, or DialogWeb. Depending on the trademark, images may be in color or black and white.

15 When searching word fragments in the Rotated Trademark index (TR=), use the @ character to indicate the end of a word, e.g., TR=MAIL@. To retrieve an embedded fragment, use the question mark, e.g., S TR=AIL?. Multiple TR= fragments can be combined with AND for the most comprehensive retrieval.

16 Does not display in record.
