| Tuesday issued a sharp rebuttal to statements by Elan Corporation | |
| disputing the legitimacy of Schering's nicotine patch patent. | |
| After examining statements made by Elan in a March 23 press | |
| release, the company said it was fully satisfied that its patent | |
| (U.S. Patent No. 4,908,213) reflected novel art and technology. | |
| Contrary to Elan's assertions, there can be no infringement of a | |
| U.S. patent application, only of an issued patent. Elan issued | |
| its press release following a March 17, 1990, article in The New | |
| York Times on Schering's patent. | |
| The company obtained its patent on March 13, 1990, for a | |
| transdermal nicotine patch designed to reduce tobacco craving by | |
| dispensing nicotine in a controlled dose over 24 hours. The patch | |
| has several advantages over orally administered nicotine products, | |
| including a superior controlled release of nicotine into the | |
| bloodstream and the avoidance of mouth and gum irritation, which | |
| nicotine gums can cause. | |
| Addressing Elan's statements, the company took strong issue | |
| with Elan's claim that Schering had failed to cite relevant | |
| prior artin its patent application, specifically Elan's inter- | |
| national patent application on transdermal nicotine delivery. | |
| Schering-Plough said that it did, indeed, cite relevant prior | |
| art in its filing and that the patent examiner offered additional | |
| references during the prosecution. | |
| The company maintains that Elan's published patent applications | |
| are no more relevant to the invention than the totality of art | |
| cited at the time Schering's application was prosecuted. Thus, | |
| Schering contends, Elan's statements were not only premature | |
| since they were made before Elan had access to Schering's file | |
| history (and, therefore, could not know what transpired in the | |
| Patent Office), but were also "off base" in imputing any | |
| irregularity to the company's filing. | |
