The Derwent Patents Citation Index (DPCI), produced by Thomson Derwent, provides access to 54.5 million patent and literature citations found in 5.5 million patent families. Each update, Examiner citations from approximately 20,000 - 30,000 documents from 6 major patent-issuing authorities are added to the file.

Each record in the database describes a patent family for a single invention. Patent citations referenced by examiners in patent documents are called "cited" patents in the DPCI record. When a citation references an older invention/patent, it is also added to the older family record as a "citing" patent. The DPCI record provides a view of retrospective technology for an invention (cited patents) and its impact on subsequent technology (citing patents).

Examiner citations are provided for family members (both basic and equivalent) added to the file from the following patent-issuing authorities: European Patent Office (EP); Germany (DE); Japan (JP), chemical and electrical examined patents only; Patent Cooperation Treaty (PCT/WO); United Kingdom (GB); and United States (US).

For the time period covered by Derwent updates 9418 through 9719, DPCI also containes cited patent data from Austria, Australia, Belgium, Canada, France, Netherlands, New Zealand, South Africa, Sweden, and Switzerland. Author citations derived from the "basic" patent in each family were also included. This data remains in the file and is searchable.

For Dialog's Redistribution and Archive Policy, enter HELP ERA online. The following terms and conditions also apply.

The online use by customers of the databases ( Derwent databases ) of Derwent Publications Limited ( Derwent ) and all data obtained from Derwent databases is subject to the following terms and conditions.

1. All data obtained from Derwent databases and all copyright therein is and shall at all times remain the property of Derwent.

2. All data obtained from Derwent databases are to be treated as strictly confidential and may not be copied, duplicated, translated into any language or in any way reproduced without the prior written consent of Derwent, except for internal use only. Customers may redistribute Derwent data obtained from the DIALOG service in accordance with Dialog's ERA redistribution program.

3. The customer undertakes and agrees that:

(a) any searches against Derwent databases will be conducted by the customer's employees for the customer's internal use only, and the results of such searches will not be disclosed or transmitted to any third party, except as permitted in paragraphs 3(b) - 3(g) below;

(b) if the customer wishes to conduct searches on behalf of a third party, the customer will notify Derwent and obtain Derwent's written consent; searches on behalf of a third party will not be permitted unless and until permission has been granted by Derwent in writing;

(c) any search conducted on behalf of a third party must be performed directly by the customer's employees and will be solely for that third party;

(d) prior to any search being conducted on behalf of a third party the customer will ensure that the third party undertakes to the customer and Derwent that the results of such search are for that third party's own internal use only;

(e) whenever the customer obtains data from Derwent databases for a third party, the customer shall notify that third party in writing of the ownership by Derwent of the data concerned and all copyright therein;

(f) copies of online and offline prints must be conspicuously marked:

FOR INTERNAL USE ONLY (c) THOMSON DERWENT 1995";

(g) the term "third party" does not refer to a patent issuing authority, such as a national Patent Office, where data obtained from Derwent databases is required by law or regulation in the normal conduct of the patent issuing authority's day-to-day business.

4. Output from online searches may be stored temporarily in electronic form for a maximum period of three months for the purpose of editing or reformatting the search results. For longer term storage, a Downloading Agreement with Derwent must be completed and the appropriate fees paid.

5. In the event of a breach by the customer, its employees or any third party, of any of these terms and conditions Derwent shall be entitled to terminate the customer's right of access to Derwent databases immediately without notice.

6. Derwent shall not in any circumstances be liable or responsible for the completeness or accuracy of any data comprised in the Derwent databases nor the transmission of such data and will not be liable for any indirect, consequential or economic loss of profit resulting directly or indirectly from the use by the customer or any third party of such data.

7. The customer will not assign any of its rights under these terms and conditions in whole or in part without the prior written consent of Derwent.

8. The invalidity, illegality or unenforceability in whole or in part of any of these terms and conditions shall not affect the validity, legality, and enforceability of the remaining terms and conditions.

9. These terms and conditions shall override and prevail over any other terms and conditions in any document or other communication used by the customer in effecting its subscription to the Derwent databases.*

10. These terms and conditions shall be governed by and construed in accordance with English law.

*For the purposes of this provision, this is in reference to direct agreement between Derwent Publications and the Customer organization.

Any questions concerning the interpretation of any of these conditions should be referred to the nearest Derwent office for clarification.
