The TRADEMARKSCAN^® - U.S. STATE database, produced by Thomson Compumark, contains information on trademarks and service marks registered with the Secretaries of State of all 50 U.S. states and in Puerto Rico. Corporate name registrations are not included. Trade names, assumed names, and fictitious names are also not generally included, but may be identified for some states.

The TRADEMARKSCAN databases principally serve as preliminary screening tools for checking on the availability of new product and service names. Like the other TRADEMARKSCAN files, the TRADEMARKSCAN - U.S. STATE database should not be used as the sole basis for clearing a new name or for filing an application. If a trademark is not found in the database, it does not necessarily mean that the trademark is available for use. Registration does, however, offer a greater degree of protection from infringement. Before a mark is adopted, additional searching is recommended, especially for common law usage, i.e., marks in use but not registered.

Most records contain the trademark, U.S. and International class numbers, ownership history, goods/services description, status, state of registration, registration number, filing correspondent, claims, disclaims, and date information pertaining to activities such as first use, registration, renewal, abandonment, cancellation, and expiration. Some information (e.g., assignments, registration numbers, and filing correspondents) is not available for all states.

Trademark words can be searched as phrases (ET=), as whole words or word beginnings in the Basic Index, or as word fragments or word endings in the rotated index TR=. Marks consisting of corrupted spellings, unconventional presentations of words, non-Latin characters, or non-English-language words have been enhanced with cross references to facilitate retrieval.

Records for some marks include images. Trademark designs and logos are referenced in appropriate fields, e.g., Design Type (DT=), Lining/Color Claims (PH=), and Design Phrase (PH=).

Thomson CompuMark's Terms and Conditions are in addition to those found in Dialog's Standard Service Agreement. If there is a conflict between these terms and conditions and those in Dialog's Standard Service Agreement, Thomson CompuMark's Terms and Conditions will apply.

Since punctuation is stripped for trademark searching, use the AND operator instead of the (W) operator for the most comprehensive retrieval. Search compound words as the whole word and as its parts, e.g., S KEYMAIL? OR (KEY AND MAIL?).
