File Description [top]

The TRADEMARKSCAN® - U.S. FEDERAL database, produced by Thomson CompuMark, provides information on all active registered trademarks, service marks, and applications for registration filed at the U.S. Patent and Trademark Office (USPTO). Pending applications include both actual-use and intent-to-use applications. International registrations under Madrid Protocol are included from November 2, 2003 forward. ONTAP® TRADEMARKSCAN - FEDERAL, File 296, is available for Online Training And Practice.

The database serves principally as a preliminary fast screening tool for checking the availability of new product or service names. A search on the TRADEMARKSCAN - U.S. FEDERAL database should not be used as the sole basis for clearing a new name or for filing a trademark application. If a trademark is not found in the database, it does not necessarily mean that the trademark is available for use. In the U.S., trademark rights are conferred by use or by filing an intent-to-use trademark application, and it is not necessary to register a trademark. Registration does, however, offer a greater degree of protection from infringement. Before a mark is adopted, additional searching is recommended, especially for common law usage, i.e., marks in use but not registered anywhere. Inactive federal registrations (again, the mark itself may still be in use) and state registrations (File 246, TRADEMARKSCAN® - U.S. STATE) should also be searched.

Each record contains the trademark, international class numbers, the owner's name, a description of the goods or services, the USPTO serial number and complete information about the status of the mark as supplied by the USPTO. Many records have additional information and historical data, such as changes in ownership and actions brought before the Trademark Trial and Appeals Board. Registered or pending marks that changed to inactive status since 1984 (i.e., expired, cancelled, or abandoned) remain in the database with the most current status indicated. Trademarks can be searched as phrases (ET=), as whole words or word beginnings in the Basic Index, or as word fragments or word endings in the rotated index TR=. Marks consisting of corrupted spellings, unconventional presentations of words, non-Latin characters, or non-English-language words have been enhanced with cross references to facilitate retrieval.

Records for Design Only marks and those that have a design element, including block and stylized lettering, include images. Trademark designs and logos are referenced in appropriate fields, e.g., Design Type (DT=), Lining/Color Claims (PH=), and Design Phrase (PH=).

Use the Basic Index to search complete words, compound words, or word beginnings, e.g., S KEY?. Use the rotated index TR= to search word fragments, or word endings, e.g., TR=MAIL?. Since punctuation is stripped for trademark searching, use the AND operator instead of the (W) operator for the most comprehensive retrieval. Compound words should be searched as the whole word and as its parts, e.g., S KEYMAIL? OR (KEY AND MAIL?).

Trademarks and owner names longer than 32 characters are truncated in REPORT displays.

Trademarks consisting of corrupted spellings, unconventional presentations of words, non-Latin characters, or non-English language words are enhanced with cross references to facilitate retrieval. Most enhancements (cross-references) to trademarks are not displayed in the record.

In a REPORT which includes date fields, NA will appear when the requested date information is not available.

Due to the nature of owner information recordation at USPTO, some records may not include all "owner types."

Use RT=IMAGE together with the query, e.g. S DOG/DESIGN AND RT=IMAGE to guarantee that a record containing a design actually contains a trademark image.

Includes All Owners (OW=) , Filing Correspondents and US Representatitves (LR=) and any TTAB field which contains a plaintiff (PL=) such as Plaintiff in an Opposition Action (OP=), Petitioner in Cancellation Action (PE), Plaintiff in Interference Action (IP=), and Plaintiff in Concurrent Use Action (UP=).

Includes marks cited in oppositions, cancellations, interference actions and concurrent use actions. Field is not enhanced for unusual spellings, translations, etc.

Most, but not all, records contain a filing correspondent or legal representative. A U.S. representative may also be provided.

Does not display in record.

Date through which official trademark applications are formalized. Use AP=9999 to establish Dialog Alerts for tracking of recently filed applications. Use OG=9999 for tracking newly published trademarks.

May not be the most current owner, especially if there have been assignments. To retrieve all current owners, use ON,AS=.

Contains all owners, past and present. Includes ON=, OW=, AR=, and AS=.

Named individuals may also be found with CM= and/or PO=.

Use the @ character to indicate the end of a word, e.g., TR=MAIL@? when searching in the rotated index. Always use the question mark for the most comprehensive retrieval.. Proximity operators (W) or (N) cannot be used with the TR= prefix. Use AND instead.

Marks inactive prior to January 1984 are not included in the database.

Includes plaintiffs in opposition, cancellation, interference, and concurrent use actions.

The various TTAB action numbers are identified with 2 digit series codes: 91 for oppositions, 92 for cancellations, 93 for interferences, and 94 for concurent use actions. The numbers have a fixed length of 8 digits, so it is necessary to combine the series digits, zero-fill and the number, e.g. CA=92007951.

Under Madrid Protocol, owners of US trademark applications or registrations can file for international trademark protection through the USPTO who will submit international applications to the International Bureau of the World Intellectual Property Organization (WIPO). The international registration data is NOTavailable for use with the REPORT command.

Design codes describe characteristics of trademark design and are searched using DS=; the corresponding design text is searched with ND=.
