The TRADEMARKSCAN® - U.S. FEDERAL database, produced by Thomson CompuMark, provides information on all active registered trademarks, service marks, and applications for registration filed at the U.S. Patent and Trademark Office (USPTO). Pending applications include both actual-use and intent-to-use applications. International registrations under Madrid Protocol are included from November 2, 2003 forward. ONTAP® TRADEMARKSCAN - FEDERAL, File 296, is available for Online Training And Practice.
The database serves principally as a preliminary fast screening tool for checking the availability of new product or service names. A search on the TRADEMARKSCAN - U.S. FEDERAL database should not be used as the sole basis for clearing a new name or for filing a trademark application. If a trademark is not found in the database, it does not necessarily mean that the trademark is available for use. In the U.S., trademark rights are conferred by use or by filing an intent-to-use trademark application, and it is not necessary to register a trademark. Registration does, however, offer a greater degree of protection from infringement. Before a mark is adopted, additional searching is recommended, especially for common law usage, i.e., marks in use but not registered anywhere. Inactive federal registrations (again, the mark itself may still be in use) and state registrations (File 246, TRADEMARKSCAN® - U.S. STATE) should also be searched.
Each record contains the trademark, international class numbers, the owner's name, a description of the goods or services, the USPTO serial number and complete information about the status of the mark as supplied by the USPTO. Many records have additional information and historical data, such as changes in ownership and actions brought before the Trademark Trial and Appeals Board. Registered or pending marks that changed to inactive status since 1984 (i.e., expired, cancelled, or abandoned) remain in the database with the most current status indicated. Trademarks can be searched as phrases (ET=), as whole words or word beginnings in the Basic Index, or as word fragments or word endings in the rotated index TR=. Marks consisting of corrupted spellings, unconventional presentations of words, non-Latin characters, or non-English-language words have been enhanced with cross references to facilitate retrieval.
Records for Design Only marks and those that have a design element, including block and stylized lettering, include images. Trademark designs and logos are referenced in appropriate fields, e.g., Design Type (DT=), Lining/Color Claims (PH=), and Design Phrase (PH=).
